PROSTITUTION will be banned from residential areas in WA and clients caught on unlicensed premises could face fines or jail under proposed laws.
Police will also get extra powers to shut down illegal brothels under the law reforms proposed by the state government.

Under the proposals, clients having sex with persons coerced into prostitution would face jail whether they knew the person was coerced or not.

WA Attorney-General Christian Porter announced the planned changes on Thursday, saying prostitutes would also be encouraged and supported to leave the industry.

``What we are trying to achieve first and foremost by this scheme is to get prostitution out of suburban and residential areas,'' he said.

``It will be clearly unlawful to have a prostitution business in such areas and we expect it will be very seriously policed with a range of new powers.''

Mr Porter said the state government, not local governments, would also take ultimate responsibility for who was licensed to run a brothel or be a prostitute and where those businesses could be located.

The industry would be heavily policed and regulated and when infringements occurred, prostitutes would be encouraged to get out of the trade, the attorney-general said.

Mr Porter said the proposed penalty for operating or managing an unlicensed brothel would be up to three years in jail.

He said the penalty for clients caught entering or leaving an unlicensed brothel would be a fine of up to $6000 or up to one year in jail.

Clients who engaged in sex with a person being coerced into prostitution would face a penalty of up to two years in jail, ``irrespective of whether it could be shown they knew the prostitute was coerced'', Mr Porter said.

Where they were aware a person was coerced, penalties of up to 14 years jail would apply, or 20 years jail if the coerced person was a child.

``These provisions place an onus on a client to be certain that a prostitute is acting of their own free will,'' Mr Porter said.

The government planned to have a draft bill ready early next year, he said.

WA is a bit on the conservative side........one of the things I realised rather sooner then later upon arrival.
I read in the paper a few months ago that the government in WA wants to establish local registers for W/Ls as well as a kind of ID every W/L would have to carry around.......yeah right!!!!!!! I was told by another W/L that that's not the first time that those ideas have been around. Apparently the laws will get introduced in 2011. (Ohhhh dear......sounds like back to the middle ages) We will see.
Great idea to post it on the forum. I don't think a lot of us W/Ls keep track of the legal situation of our trade.

they are referring to brothel's operating out of residential area's any residential place that has 2 or more working from is classed as an illegal brothel..As for pvt independent sole operators go it shouldn't be illegal as we didn't get a mention at all. We will see what happens next year has been tried before and never got passed.
 
This gas me worried about my favourite part of the industry, the r'n't places. Almost looks like these are the places they have in their sights.

....that will depend on how terms or words such as "sex", "prostitution", "prostitute", "sex worker" etc etc are defined. It is said that the devil is in the detail. With Bills, that detail also involves definitions. Hopefully, an Explanatory Memorandum (or some such instrument) will be available as these are tabled in parliament to put a Bill in plain English (or at least try to) so that pollies can then vote accordingly.

Terrible laws: punters demand liberal trade laws. In my opinion Government should never interfere with a free trade market. Sex workers are human commodities to be bought, sold and traded.

More sex trade de-regulation is needed not tight conservative regulation restricting the sex trade industry.

Sex workers must pay off their debts owing to their masters/brothel keepers. The sex trade will be forced to operate underground due to the restrictive new laws.

If they are going to stop the dodgy Asian pimps and gangsters opening brothels in sururban houses and staffing them with imported ladies who are little more than sex slaves that gets the Svengali seal of approval. That is an ugly trade and deserves to be shut down. Please also remember that these operations do have a real impact on the amenity of the area they work in. They don't attract the cream of the punting world and having the extra traffic and possibly noisy disturbances at night is not something any resident should have to put up with.

Getting rid of suburban knocking shops could also be beneficial to those people running proper houses. More punters would lead to better amenities and possibly even lower prices brought about be increased turnover and keener competition.
 
This takes us back to the dark ages. Perth is backward..and a nanny state...This is all about control and human rights."Big Brother"....This will be the end of the government...if it keeps trying to legislate everything!!!!
 
i agree , the devil is in the detail . as with most of these laws there is alot in the interpretation of how they are implied and the definition of the terms. alot of these laws ,and lets not forget they are only proposed and in no way garanteed to become full law ,are not really anything new . the sex act from 2000 says alot of the same things . these new laws do suggest the police will have more power to act though . the laws are still sketchy at best and leave alot open at the moment .
 
They are talking about all industry services in residental areas. The plans they have will effect every private operator and close down at least 40% of the industry that is operating now.
I did warn all some time ago to get together and get a lobbyist, the way things are going Privates are going to be at high risk of being outlawed totally.
If they can't be bothered protecting their right to work as privates by starting a lobbyist movement, they will have to suffer the consequences.
By the way Tahlia, what they are proposing isn't the slightest bit sketchy and the police will have all the rights to enforce. Under this law everyone will be guilty until they can prove they are not guilty.

I think that this type of Law needs referring to the Human Rights Commission and it may be in contravention of the Australian Constitution in relation to the assumption of guilt rather than innocence.

No doubt there will be quite a few Politicians, Judges, Doctors and CEOs shaking (or should that be sniffing) in their boots over this proposal.
