Under use of condoms (prophylatics) it is an offense to offer cunninglus or mutual french with out the dental dam in between. This will disadvantage the business as it would be just about impossible to police this for the private worker community.
From how I read it, it would also make Golden Showers outside the law and passionate kissing.
I would bet we get a lot of feedback on this provision.

What is the concern with passionate kissing and how on earth will they police some of these provisions

They might do what centrelink does to investigate fraud and hire some guys to "use the services" and see what they provide.......hehehe......i reckon there'd be a few people lining up for that job!

nothing new____is illegal now.

these are not new provisions.

golden showers and lick lick of female without a dam was illegal before, nothing new.

that's right, its always been illegal to have any form of unoprotected sex, including natural french on both males and females.. first i hear about kissing though..lol maybe we all have to stop all sorts of kissing anywhere.. kissing in public etc...

the way they can patrol it is actually ask over the phone if you provide those services, then they book and come and see you and produce their badge...

You are both wrong on it being illegal before.
The act in 2000 provided you must use condoms for penetrative sex, now it says that no bodily fluids must pass between the sex worker and the client.
Saliva from kissing is a bodily fluid, so is urine with a golden shower.
It was not illegal to have natural french and the risk of infection has never be proven to pass HIV
How will they police it? It would be impossible to police except where a worker on the phone stated that she offered certain services with out using protection.
This means that all sex workers will have to be cautious on what information they give out on the phone.
A interesting note is the GAY Council of Australia has never encouraged condom use for oral sex. I spoke with the head guy in WA three years ago and they said by allowing french without condoms the guys were more likely to use condoms for penetrative sex.

That is interesting - provide a little leeway on one thing and you find people will use common sense on the next level up. Now gee if only they could use common sense like this in school administrations *grumble grumble*

Actually maryanne, I am not wrong on that one. It was told to me from the mouths of Vice themselves.

The also had been ringing up girls - especially the asian ladies that were flying in and out from over east and asking if they provided natural french.
If they said yes, they then made a booking and turned up at their place showing them their badges and telling them it was illegal to offer that service.

It was also illegal for a woman to do it without a dam, but guess they couldn't control that one without going through with the whole service...lol

natural was for sex, french on both woman and man...
so my facts were from those that were trying to police it.....

If utilising the services of a working lady isn't illegal then surely they could make some coppers/investigators go the whole way. I predict this to be the future - and won't resulting court cases be fun! Imagine having to testify to that! And all the girls will be frisking guys at the door. Sorry.....my flights of imagination are looping freely tonight.

Really

I thought entrapment was illegal...how is such a thing policed..r the boys clutching at straws now?:la:

Daintree this is totally off the wall but i am just wondering - why did you pick that as your username?

Finally, there is someone who is very well respected in this industry who agrees with me.

We are very quickly becoming like singapore, where i believe it is illegal to have oral sex...even between a husband and a wife. but we all know that you can get a you are silly from a hair dresser for $50.

Though not illegal or proven to pass HIV it is a high risk activity for gonorreah and other stds.

As to the kissing law i think this one sucks. I myself prefered a booking where I was able to kiss it made it seem less like work.

I think this is going to be aimed more at the 'private' market as as others have said is the state actually going to allow officers pay for sex and get to the act, then as soon as the DATY or 69 starts suddenely say "you're busted"? I don't think so.
Soin the end it's going to be what is said in adverts that counts.
Ho hum

Tes it will be just about impossible to prove, but under the laws they do not have to prove that a offense has been committed. If someone is charged that person has to prove that they are innocent.
This means that if someone steps on the wrong toes this could be held against them, it also means they could ring the lady request the service and if she said it was available natural, she could be in the shit.
I do not believe this is the position the law makers want, and I hope we can get the rules changed so that all that work in the industry are treated fairly and can be honest from the day they actually start.
To do this we need the ladies of the industry to help put there side of the story to the decision makers.
I ask you to encourage all sex workers to do there bit so we get fair rules for all. I have heard that some agencies are lobbying councils to make privates have to have home occupation permits to work, they will win this if the privates don't start showing some interest in there own business.

So it is now similar to QLD where any uncovered services are illegal. Heck it is illegal even to ask for uncovered services in QLD!

Doesn't mean that uncovered services don't happen of course. It is all about educating the girls. Don't admit to doing uncovered services over the phone or by email. Don't even admit to it when in a face to face situation until after money has changed hands and clothes are off! My understanding (albeit limited) is that the police aren't allowed to get their gear off and engage in any service with the lady so they try to get the lady to tell them what they do beforehand.
